About two weeks ago, we reported that eBay had lost a counterfeit case with Hermes. In that instance, eBay got away with being fined a mere 20,000 Euros. As a few of our readers pointed out to us today, eBay got a hefty slap on the wrist this time.
PARIS — A French court on Monday ordered the online auction giant eBay to pay 38.6 million euros, or $61 million, in damages to the French luxury goods company LVMH, in the latest round in a long-running legal battle over the sale of counterfeit goods on the Internet.
LVMH, a maker of high-end leather goods, perfumes and other fashion and luxury products, successfully challenged eBay for a second time in the French court, arguing that 90 percent of the Louis Vuitton bags and Dior perfumes sold on eBay are fakes.
The court ruled that eBay, which earns a commission on the sales, was not doing enough to stamp out counterfeit sales.

We can only hope that this ruling will aid in removing some of the fake junk off eBay. It is the buyer that would benefit most of it.

its awesome! but its really hard to actually maintain a control in this in my very humble opinion, cuz there so many ways to trick and it must be very complicated to actually get the order that we all want, but i hope this helps that they be more careful on wut they let in their website,after all they pay for the losses not the mean persons that do the scams.

I am glad that somethin gis being done to crack down on ebay, but I have a feeling that htis is going to mean more fees for sellers!!
This is a huge step in the right direction; bravo to LVMH for sticking to their guns. Of course, I have a sinking feeling that ebay’s going to hit us buyers and sellers with some of these costs…
Finally! As great as it sound, I hope eBay will not force higher fees for buyer and seller. Also pull out those real fakes, not just because VERO or their team ‘thinks’ it’s fake.
A ruling such as this would never happen in the USA. If LV was able to obtain such a ruling it would have happened a long time ago. There is nothing wrong with a designer inspired handbag, if labeled as that. It is terrible if a seller is selling fakes but telling people it is a real. That is consumer fraud. Giving people what they knowingly want is not a bad thing, is it?
Finally, it was long over due
It is most determinately wrong to sell anything with a brand name on it if it is not genuine. It is stealing no matter what legal loopholes are found. There are ways for eBay to make sure sellers are selling genuine items but they wont take the time to do that when there is so much money to be made on fakes. I think the fees will go up to the sellers when its so hard to make any money now as it is.
